JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2019 This is an application for grant of anticipatory bail in connection with Kashichak P.S. Case No. 145 of 2018, disclosing offences under Sections 25(1-b)A, 26 of the Arms Act.

Allegation as per F.I.R. is that police got an information about the altercation between the parties and reached at the place of occurrence and in the torch light, he saw one person standing with rifle and after seeing the police, he fled away and the petitioner is also named in the F.I.R. Submission of learned counsel for the petitioner is that the recovered rifle is without trigger and was not in working condition, moreover no recovery from the possession of the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.
