JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Kutumba P.S. Case No. 133 of 2019, registered for offences punishable under Sections 420, 467, 468, 471, 414 and 34 of the Indian Penal Code.

Prosecution case is that police in course of vehicle checking caught one person with motorcycle and on being asked to show the papers of motorcycle, he failed to produce the same and told that his father has purchased the said motorcycle from one Kanchan Kumar and has created the false document of the motorcycle and he further disclosed that the said Kanchan Kumar has also sold a stolen motorcycle to the petitioner Sonu Singh. It has been submitted on behalf of the petitioner that he has falsely been implicated on confession of co-accused and except that there is nothing against the petitioner. There is no recovery from his possession and he has been in judicial custody since 26.09.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kutumba P.S. Case No. 133 of 2019, subject to the condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of six months so that the police may watch his conduct during that period.

Let a copy of this order be communicated to the Superintendent of Police, Aurangabad for needful. It is with further subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court, failing which, the prosecution shall move for cancellation of his bail bonds.
