JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioner is languishing in custody since 06.02.2015 in connection with Hajipur Sadar P.S. Case No. 60 of 2015 for the offences instituted under Sections 341, 323, 504, 506, 307, and 379 read with section 34 of the Indian Penal Code. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 05.02.2015 at 11 A.M. when the informant was ploughing his field, all the accused persons arrived there and the petitioner pointed pistol upon him and fired upon him but anyhow the informant was saved. Accused Shankar Rai gave threat to kill the informant and his sons as the informant was not inclined to withdraw the case. On the order of Shankar Rai, the accused persons assaulted the informant with lathi, Danda and fists, slaps and pistol and made

It has been submitted on behalf of the petitioner that the petitioner is said to have assaulted with the butt of the pistol. Further it has been submitted that the petitioner has no criminal antecedent and he is in custody since 06.02.2015. It has been pointed out that vide Annexure-2 to the present application; the matter has been compromised between the parties. It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S.
