The alleged recovery of firearm has been made from conscious possession of the co-accused Nagendra Singh @ Nagendar Singh and so far as petitioner is concerned, it is only stated that the aforesaid recovery was made on the basis of confessional statement of the petitioner. Moreover, co-accused Nagendra Singh@ Nagendar Singh has already been granted privilege of bail by this Court.

No doubt, petitioner carries criminal antecedent of several cases but taking note of the aforesaid facts as well as submission of the parties, let the petitioner, above named, be
