The petitioner was placed at serial no. 1 in the merit list for being considered for grant of license for running the petrol pump outlet of Indian Oil Corporation. However, on complaint by private respondent no. 7 no

Patna High Court CWJC No.4605 of 2017 dt.27-02-2020 2/3 agreement was concluded with the petitioner as a complaint was made with respect to the title of the petitioner over the land which was offered. The Title Suit has now been dismissed, though for non-prosecution. However, from the counter affidavit filed by Indian Oil Corporation, Mr. Agarwal, learned senior advocate has shown to this Court that this aspect has been taken note of by the oil company and the petitioner has been asked to provide all documents required for fresh title search and report.

In view of the aforesaid stand of the respondent oil company, the petition is sought to be withdrawn with the liberty to the petitioner to approach the authorities and offer the documents so demanded so that the claim of the petitioner could be processed as expeditiously as possible. The prayer made on behalf of the petitioner appears to be absolutely genuine and this court does not find any difficulty in allowing the same.
