JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Learned counsel for the petitioners seeks permission to withdraw this petition as against petitioner no. 1, namely, Satendra Chaudhary.
Accordingly, the petition is dismissed as withdrawn as against petitioner no. 1.
Heard learned counsel for the petitioner no. 2 and the State.
The petitioner no. 2 is apprehending his arrest in a case instituted under Sections 304B/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused caused death of daughter of the informant due to non-fulfilment of demand of dowry.
It is submitted on behalf of the petitioner no. 2 that he has got no criminal antecedent. He is father-in-law of the deceased. He is separate in mess and property from the husband of the deceased.
On behalf of the State, it is submitted that petitioner no. 2 is named in the F.I.R.
Patna High Court Cr.Misc. No.5509 of 2016 (2) dt.18-03-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner no. 2, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Motihari Sadar, East Champaran, in connection with Govindganj P.S. Case no. 104 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
