Petitioner is seeking anticipatory bail in connection with Asarganj P.S. Case No.98 of 2018 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the as per the allegations in the First Information Report, the daughter of the informant went missing from 25.08.2018 but the First Information Report was lodged after five days i.e., 30.08.2018. It is further submitted that the girl is a major girl and she has solemnized marriage with this petitioner out of her free will and volition. In her 164 Cr.P.C statement, a certified copy of which has been produced before this Court by the learned counsel for

Patna High Court Cr.Misc. No.4553 of 2019(2) dt.11-02-2019 2/2 the petitioner, she has made a statement that on 25.08.2018 she had left her house on her own and had solemnized her marriage with this petitioner on 04.09.2018.

Learned APP for the State is present and has opposed the prayer for bail.

In the given facts and circumstances, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/-(rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Chief Judicial Magistrate, Munger in connection with Asarganj P.S. Case No.98 of 2019, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
