JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 Petitioner is languishing in custody since 09.09.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act and Section 17 of the Criminal Law Amendment Act.

On information that at the residence of coaccused Shankar Prasad the extremists have assembled, raid was laid and Shankar Prasad was apprehended, from whose possession the country made pistol, cartridges and other incriminating articles were recovered who suggested the name of the petitioner.

It is submitted by learned counsel for the petitioner that that admittedly the petitioner was not apprehended from the place of seizure and there is no recovery from the petitioner and after institution of the present case the petitioner has been remanded in three other pending cases.

No.11321 of 2015 (2) dt.27-03-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarahana at Motihari in connection with Rajepur P.S. Case No. 44 of 2014.

Since the petitioner is accused in three other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
