Patna High Court CR. MISC. No.5276 of 2023(2) dt.21-02-2023 2/2 instant matter relates to the recovery of very small quantity of foreign liquor of 1.80 litres kept in six tetra packs but the said recovery was not made from the conscious possession of this petitioner and the same was recovered near a factory and the petitioner was not apprehended at the spot and against him there are criminal antecedents of six cases and in most of the cases he was remanded and in the instant matter he has been languishing in jail since 15.11.2022.
