The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 447, 353, 387, 504, 506/34 of the Indian Penal Code.
It is alleged that the petitioner being the Chairman of Arwal Nagar Parishad along with others tried to snatch the key from the Computer Operator in order to remove the paper relating to No Confidence Motion. It is submitted by the learned counsel for the petitioner that the petitioner preferred a writ application before this Court, in which certain allegations were levelled against the Executive Officer hence, the present case has been lodged maliciously. From perusal of the
Patna High Court Cr.Misc. No.11350 of 2015 (2) dt.19-03-2015 First Information Report, it appears that no offence either under Sections 353 and 387 are made out. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Arwal P.S. Case No. 07 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
