JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is stated that 1.5 kg. ganja was recovered from the room of the petitioner. Petitioner is in jail custody since 21.01.2015 and he does not have any criminal antecedent. The contention on behalf of the petitioner is that even if the seizure of ganja from the room of the petitioner assumed to be true, then also, the seized ganja comes under the purview of small quantity.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.14816 of 2015 (2) dt.08-04-2015 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in connection with Sherghati P.S. Case No. 13 of 2015.
