The petitioners are apprehending their arrest in connection with Pipra Kothi P.S.Casse no.146 of 2018 dated 20.7.2018 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 307,379 of the Indian Penal Code. Allegation against the petitioners is of assault to the informant and his mother and specific allegation against the petitioner no.2 is of assault by 'Farsa' to the informant and thereafter to his mother.

Patna High Court CR. MISC. No.6480 of 2019(3) dt.01-04-2019 2/3 Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and the matter has been compromised.

Heard learned A.P.P. , who has opposed the prayer for bail stating that one of the injuries is grievous. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner nos.1. Rajeshwar Mahto, 3. Ram Babu Mahto, 4. Umesh Mahto, 5. Laichi Devi, 6. Ramji Mahto and 7. Shiv Balak Mahto in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, District East Champaran in connection with Pipra Kothi P.S.Case No.146 of 2018 dated 20.7.2018, subject to condition as laid down under Section 438

(2) of the Code of Criminal Procedure.

So far petitioner no.2 (Madan Mahto) is concerned, he will surrender within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit. With the aforesaid direction, this application is
