The petitioner seeks bail in a case under Sections 302/201/34 of the Indian Penal Code.

The informant alleged that the petitioner Ram Babu Sah took her husband from the house of her daughter and the dead body of her husband was found. It is submitted that the informant is not an eye witness of the occurrence and, on mere suspicion, names of the petitioner and others have been given. The petitioner has got enmity with the husband of the informant as the deceased had received money for supplying labours. It is further submitted that Prabhu Sonar has already been enlarged on bail. The case of the petitioner stands on the same footing as that of Prabhu Sonha. The deceased died due to accident.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.11635 of 2015 (2) dt.06-04-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in Patahi P.S. Case No. 113/2012.
