Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 308(3), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young boy aged about 22 years and the informant alleges that on 24-112024 at 7 pm, the petitioner along with named accused persons came to his shop and demanded extortion of Rs. 5,000/-, on protest, the accused persons assaulted him, further some accused caught him and Triloki Bind assaulted him by iron rod causing injury on head, further other accused also assaulted him by rod

Patna High Court CR. MISC. No.2745 of 2026(2) dt.28-04-2026 2/3 and Triloki again tried to assault by rod but informant along with witnesses caught his hand, thereafter Triloki took out Rs. 20,000/- and fled while Raja Lal Choudhary snatched his chain. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that it is not a case of extortion rather there was a dispute with regard to payment since informant runs a grocery shop on account of which an altercation took place in which both sides assaulted each other. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that no specific allegation is alleged against the petitioner. It is also submitted that Triloki Bind had approached this Court seeking anticipatory bail by filing Cr. Misc No. 36926 of 2025 and the same came to be allowed by an order dated 18-6-2025 by a learned Co-ordinate Bench.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail
