JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 25-06-2015 The petitioner prays for grant of bail in Jalalgarh P.S. Case No. 54 of 2014 (S.T.No.1028/14) registered under sections 302 and 201 IPC.

Upon finding an unidentified dead body of a woman the Chaukidar lodge the case against unknown. In course of investigation, it was revealed that for kidnapping of the women another case was lodged in which the petitioner was identified as the accused. The dead body of the women was identify as one who was kidnapped by the petitioner.

Considering the allegation levelled against the petitioner and the materials reflected from the impugned order, I am not inclined to enlarge the petitioner on bail. His prayer for bail is accordingly rejected.

Considering the incarceration of the petitioner, this Court grants him liberty to renew his prayer for bail in the court below itself if all the prosecution witnesses are not examined within nine months from the date of receipt/production of a copy of this order.
