JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a/32(2)(3)/36/41(1)(2) of the Bihar Prohibition and Excise Act.

Prosecution case is that 200 liters country made liquor was recovered from behind the house of the petitioner. Learned counsel appearing for the petitioner submits that the no incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent of similar nature.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.6984 of 2023(2) dt.17-04-2023 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Bahadurpur Police Station Case No. 315 of 2022/ Special Case No. 2283 of 2022 from the Court of Exclusive Special Judge, Excise, Patna city, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
