2. The petitioner seeks regular bail in connection with Turkauliya (Banjariya) P.S. Case No. 1094 of 2023 registered on 20.10.2023 lodged under Sections 380/457 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against one named and one unknown accused persons including the petitioner.

4. Counsel for the petitioner submits that name of the petitioner has been figured in this case by the virtue of CCTV footage but nothing incriminating has been recovered from the possession of the petitioner nor he was put on T.I.P.

5. Counsel further submits that petitioner is innocent

Patna High Court CR. MISC. No.5432 of 2024(2) dt.07-02-2024 2/2 and has committed no offence. He further submits that petitioner is in custody since 22.10.2023 having clean antecedent. He further submits that the petitioner is ready to face the trial as he has been falsely implicated in the present case.

6. Learned counsel for the State opposes the prayer for bail and submits that petitioner has been identified by virtue of CCTV footage.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya (Banjariya) P.S. Case No. 1094 of 2023.
