Although petitioner is named in the first information report but nothing has been recovered from his conscious possession. The petitioner does not have any criminal antecedent and is languishing in jail custody since 12.08.2015 whereas, having more or less similar allegation, co-accused Rahul Kumar has already been granted privilege of bail by a co-ordinate Bench of this court.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. case No.41/2015.
