For the Petitioner/s : Mr. Swapnil Kumar Singh For the Opposite Party/s : Mr. Amitesh Kumar(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-05-2015 Heard both sides.
The petitioner seeks bail in Sultanganj P.S.Case No.314 of 2014 registered under Sections 394, 358 459 IPC. The petitioner is not named in the first information report but in his statement, he confessed his guilt. It would appear from para-84 of the case diary that on disclosure made by the petitioner, the stolen articles were recovered from his hut. It is submitted that the petitioner has got no criminal antecedent.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail and accordingly, the same is rejected. The trial court is directed to expedite the trial and conclude the same within a period of one year from the date of receive or production of a copy of this order. If the trial is not concluded within the stipulated period without any fault of the petitioner, he may renew his prayer for bail. (Prabhat Kumar Jha, J) ahk/- U T
