The petitioner apprehends his arrest in connection with Shambhuganj P.S. Case No.106 of 2022 registered under Section 379 of the Indian Penal Code and Mines and Minerals (Development and Regulation) Act, 1957 Rule 4(1), 21 and Bihar Minerals (Concessions, Prevention of Illegal Mining, Transportation & Storage) Rules, 2019.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. No recovery has been made from possession of the petitioner. The name of the petitioner has surfaced in the present case only on the basis of statement of Chowkidar. The petitioner has got no criminal antecedent.

No.4595 of 2023(4) dt.07-04-2023 2/2 Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No.106 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
