JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 171 of 2018 lodged for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Allegation against the petitioner is of subjecting his wife to cruelty with respect to demand of Rs.1 lakh as dowry and ousting her from matrimonial house.

Submission of learned counsel for the petitioner is that he is still ready to keep his wife with him with dignity and care. On the other hand, learned counsel for opposite party No.2 has submitted that he has no objection if petitioner has taken her with dignity and care.

Having heard both sides and in the facts and circumstances, as stated above, let petitioner, above named, surrender in the court below on 11.4.2019 and file a petition that he is still ready to keep opposite party No.2 with him with dignity and care and opposite party No.2 shall also remain present in the court on that day and if the petitioner is ready to take her to his house from the court itself, he will be released on provisional bail by the learned court below for a period of six months and during that period the learned court below will watch the conduct of both the parties, specially the petitioner and if the court below is satisfied with the conduct of the petitioner, the court below will confirm the bail bond of the petitioner, otherwise the court below may pass any order(s) as it may deem fit and proper.

With the above observation, this application is disposed of.
