JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although petitioner is not named in the first information report but from perusal of the impugned order of learned Additional Sessions Judge, I find that in course of investigation, petitioner was arrested and he was put on test identification parade, in which, petitioner was identified by the informant.
Therefore, considering the aforesaid facts and circumstances, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Sadar P.S. Case No. 222 of 2015 pending in the court of learned Chief Judicial Magistrate, Muzaffarpur stands rejected. (Hemant Kumar Srivastava, J) A.K.V./- U T
