JUSTICE RAKESH KUMAR ORAL ORDER 10-05-2017 On call, again a prayer was made on behalf of the petitioner for granting accommodation, whereas, learned AC to SC No. 28 submits that in view of the facts disclosed in the counter affidavit filed on behalf of the respondent no. 5 and 6 on 19th January 2016 it is evident that the relief sought for in the writ petition has already been granted. He further submits that earlier also the case was adjourned on the prayer of learned counsel for the petitioner to obtain instruction in view of the facts disclosed in the counter affidavit.

I have perused the statement made in paragraph no. 10

Patna High Court CWJC No.12257 of 2008 (5) dt.10-05-2017 2/2 of the counter affidavit as well as the relief sought for in the present writ petition that was in respect of arrear of salary to the tune of Rs. 1,26,769/-. Annexure 'A' to the counter affidavit is a bankers cheque issued in favour of the petitioner for the said amount .

In view of the statement made in paragraph no. 10 of the counter affidavit , there is no reason to further keep the matter pending.

The writ petition stands disposed of.
