JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 21.09.2015 in a case registered for the offences punishable under Sections 20(B1), 23, 25, 27A and 29 of the NDPS Act. The prosecution case is that on information received from the intelligence output, one Scorpio was intercepted in which co-accused Chhotu Yadav, Naukej Kumar Patel and the petitioner were sitting. From the alleged vehicle, 85 Kgs. of ganja, fake currency notes of 1000 and 500 denominations worth `1,50,000/- were recovered.
It is submitted by learned counsel for the petitioner that recovery has been made from the vehicle in question. The petitioner was simply travelling in the vehicle. A statement has

Considering the commercial quantity of recovery, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected in connection with Nabinagar P.S. Case No. 138 of 2015 pending in the court of learned Special Judge, NDPS Act, Aurangabad. Let the trial be expedited.
