The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

Petitioner is under suspicion to have committed murder of his wife for the reason that petitioner was having relationship with some other lady. The petitioner is in custody since 02.09.2018.

Submission is that during entire investigation no direct evidence came against the petitioner nor anyone claims to have seen the occurrence. Investigation of the case is

Patna High Court CR. MISC. No.5383 of 2019(3) dt.19-04-2019 2/2 already complete. The petitioner is ready to cooperate with the trial.

Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gurua P.S. Case No.167 of 2018, with condition that petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
