JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 272, 273 of the IPC and u/s 30(a) of the Bihar Prohibition and Excise Act. As per the prosecution case, 3526 liters of illicit liquor has been recovered from two vehicle and this petitioner was apprehended on the spot.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 10.09.2021. Investigation is complete.

Considering the rival submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court concerned in Bangara Police Station Case No. 98/2021, once the charge is framed in the case.
