JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier the prayer for bail of the petitioner was dismissed twice firstly vide order dated 12.10.2018 passed in Cr. Misc. No. 54798 of 2018 and secondly vide order dated 11.04.2019 passed in Cr. Misc. No. 22918 of 2019 and allegation against the petitioner is that he called the son of the informant, thereafter, his dead body was found and it is suspected that petitioner and others have killed the son of informant.

Submission of learned counsel for the petitioner is that while rejecting the prayer for bail of the petitioner vide order dated 11.04.2019 passed in Cr. Misc. No. 22918 of 2019, liberty was given to the petitioner to renew his prayer for bail after framing of charge and now the charge has been framed and petitioner has been in custody since 18.05.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IV, Muzaffarpur, in connection with Sessions Trial No. 519/2019 arising out of Siwaipatti P.S. Case No. 33 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds (Vinod Kumar Sinha, J) sunilkumar/- U T
