The petitioner seeks bail in a case registered for the offences punishable under Sections 386, 427, 506, 341, 323, 395, 412, 120B of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 27.03.2021, charge-sheet has been submitted in this case and has antecedent of one case. The learned counsel for the petitioner submits that the petitioner, who carries an antecedent of one case, was convicted in that case and is still serving his sentence of life imprisonment since 26.02.2006.

The learned counsel for the petitioner submits that when the petitioner is admittedly in custody serving his sentence

Patna High Court CR. MISC. No.3140 of 2022(2) dt.26-05-2022 2/2 since 2006 till date, how could he have participated in the present occurrence. This amply demonstrates that the petitioner has been falsely implicated in the present case. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S. Tr. No.382 of 2021 arising out of Laheri P. S. Case No.295 of 2017. The application stands allowed.
