1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Jamo Bazar P.S Case no.191 of 2024 registered under sections 302, 326 and 34 of the Indian Penal Code.
3. As per the prosecution case, the informant states that on 12.6.2024 her son went to sleep and on the next morning, the mother-in-law of the informant found him lying on bed with his neck twisted and foam coming out of his mouth. When he was taken to the hospital, the doctor declared him dead.
4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. He was falsely implicated in
Patna High Court CR. MISC. No.2932 of 2025(3) dt.11-04-2025 2/3 the case in course of investigation when he was allegedly named in the confessional statement of one Ahmad Hussain. Referring to the statement made in paragraph no.12 of the petition, it is submitted that the said Ahmad Hussain happens to be an accused in connection with Jamo Bazar P.S Case no.283 of 2024 lodged by the petitioner's mother with respect to kidnapping of the petitioner's sister. Even accepting the allegations for the sake of argument, at best the case against the petitioner is one of last seen. The petitioner is in custody since 23.9.2024 and chargesheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the material that has transpired in course of investigation, the submissions made by learned counsel for the petitioner, the statement made in paragraph no.12 of the petition, the petitioner having remained in custody for 6 months since 23.9.2024 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Jamo Bazar P.S. Case no.191 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties
Patna High Court CR. MISC. No.2932 of 2025(3) dt.11-04-2025 3/3 of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Siwan.
