The petitioner is in custody in a case registered for offences punishable under Sections 30(a), 33 and 41 of the Bihar Prohibition and Excise Act.
This is a case of recovery of illicit wine and the allegation is that the petitioner is involved in the trade of the wine illegally.
It is submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in this case, no recovery is made from the conscious possession of the petitioner and on the basis of the confessional statement of the apprehended co-accused persons the name of the petitioner came into light. The petitioner is remanded in this case from
Patna High Court CR. MISC. No.4102 of 2023(2) dt.28-02-2023 2/2 other case. The petitioner is in custody since 12.11.2022. The learned Additional Public Prosecutor for the State vehemently opposed the prayer for bail.
Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Arwal P.S. Case No. 330 of 2021 to the satisfaction of the Special Judge, Excise, II, Jehanabad.
