Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. The allegation against the petitioner is that petitioner assaulted Md. Shamim with sword on his right shoulder and Shamim became unconscious.

It is submitted that there is a case and counter version bearing Bajpatter P.S. Case No. 213 of 2013 in which the petitioner is the informant and his brother was killed. Md. Shamim has got lacerated wound which is opined to be simple.
