JUSTICE ASHUTOSH KUMAR) 09-03-2022 Heard Mr. Suresh Prasad Bhakta, learned Advocate for the petitioner and Mr. Anisul Haque, AC to AAG 5 for the State. The license of the petitioner was cancelled after the same was first suspended on account of the petitioner having been made an accused in a criminal case involving breach of the provisions of the Essential Commodities Act.
The petitioner appears to have been noticed whereafter a decision was taken by the licensing authority to cancel his
Patna High Court CWJC No.1207 of 2022(3) dt.09-03-2022 2/2 license.
Against the aforesaid order of cancellation of license, the petitioner approached this Court without exhausting his remedy of preferring an appeal. Under the direction of this Court, the petitioner though applied before the appellate authority but the order of the licensing authority cancelling the license of the petitioner was sustained.
The petitioner has challenged the aforesaid order of cancellation of license and the appellate order sustaining the same.
After some arguments, learned counsel for the petitioner seeks permission to withdraw this application in order to challenge the aforesaid orders before the revisional authority. Should such revision petition be filed before the Divisional Commissioner/revisional authority, the same shall be taken up and after affording all opportunity to the petitioner, the revision petition shall be disposed of by a reasoned order within a period of 30 days thereafter.
With the aforesaid direction/observation, the petition is permitted to be withdrawn.
