In the present case, the petitioner is seeking bail in connection with Vishnupad P.S. Case No.123 of 2019 registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act as well as later on Section 414 of Indian Penal Code was added.

Allegation against the co-accused including the petitioner is to have killed a constable during checking of vehicle.

Counsel for the petitioner submits that the petitioner has not been named in the FIR. His name has come during investigation. He further submits that the petitioner is in judicial custody since 14.07.2019.

Patna High Court CR. MISC. No.1109 of 2020(9) dt.28-04-2021 2/2 Counsel for the State has pointed out that in CCTV footage the petitioner has been identified to have fired upon the constable which led to his death.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. (Shivaji Pandey, J) V.K.Pandey/- U T
