The petitioner seeks bail in connection with Revilganj P.S. Case No. 92 of 2014 registered for the offence punishable under Section 392 of the Indian Penal Code. Allegedly three motorcycle borne criminals snatched Pulsar motorcycle bearing registration no. BR04P-4092 of the informant at the point of revolver. During investigation the name of the petitioner transpired.

Submission is of false implication and that the petitioner is not named in the First Information Report, his name has come on the basis of confessional statements of Niraj Kumar Singh @ Kanchan Singh and Raju Patel, the petitioner is suffering

Patna High Court Cr.Misc. No.6885 of 2016 (2) dt.02-03-2016 in custody since 01.08.2015 but he has not been put on T.I.P. and nothing has been recovered from his conscious possession. The other co-accused Santu Pandey @ Ritesh Pandey and Nandan Singh have been allowed bail vide Cr. Misc. No.57237 of 2015 and Cr. Misc. No.46042 of 2015.

The learned A.P.P. is not in a position to distinguish the case of the petitioner from that of those co-accused. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Judicial Magistrate, Saran at Chapra, in connection with Revilganj P.S. Case No.92 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
