The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) and 37(a)(d) of the Bihar Prohibition and Excise Act, 2016. It is alleged that 10 litres of Mahua liquor were recovered from the house of the petitioner.

Learned APP submits that the recovery has been made from the house of the petitioner.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. However, in view of the nature of recovery, it is a case for consideration of prayer for regular bail by the learned Court below, if the petitioner surrenders before the learned Court below within a

Patna High Court CR. MISC. No.1170 of 2020(2) dt.25-02-2020 2/2 period of six weeks from today in connection with Buniyadganj P.S. Case No. 124 of 2017, pending in the Court of learned Special Judge, Excise, Gaya.
