JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence under Section 414 of the Indian Penal Code. As per the prosecution case, this petitioner alongwith co-accused Pawan Rathaur have been apprehended with stolen pick-up van and on search one master key and one mobile have been recovered from the possession of this petitioner. It is submitted on behalf of petitioner that nothing has been recovered from the possession of the petitioner and petitioner has been made accused only on suspicion, while he was standing near a dhaba. Petitioner has got clean antecedent and he is in custody since 24.08.2021.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Kotwa P.S. Case No. 225 of 2021.
