JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Complaint Case No. 286 of 2017 registered under Section 498 A of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is submitted that in Annexure2, it appears that petitioner was abducted by the mother of the complainant with the help of some criminals, for which petitioner has already filed a complaint before the Court of C.J.M., Samastipur and thereafter on enquiry, the police

Patna High Court CR. MISC. No.1947 of 2020(5) dt.25-10-2021 2/2 submitted his report that petitioner's marriage was forcibly performed. Further he submits that petitioner has also filed a Matrimonial Suit No. 94 of 2017 in the court below for declaring void marriage as contained in Annexure-3. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Chief Judicial Magistrate, Dalsinghsari, Samastipur in connection with Complaint Case No. 286 of 2017 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
