The petitioner seeks bail in connection with Manjhi P.S. Case No. 105 of 2014 registered for the offence punishable under Section 395 of the Indian Penal Code.
The petitioner is not named in First Information Report but during course of investigation on the basis of confessional statement of co-accused Raju Patel, the name of the petitioner and others transpired.
Submission is of false implication and that in this case co-accused Nandan Singh and Santu Pandey @ Ritesh Pandey have already been allowed bail vide Cr. Misc. No. 45138 of 2015 and Cr. Misc. No. 56687 of 2015 by another coordinate Bench of this Court and the petitioner is suffering in custody since
Patna High Court Cr.Misc. No.6966 of 2016 (2) dt.02-03-2016 01.08.2015 without any legal and cogent material as nothing has been recovered from the possession of the petitioner and further he has not been put on T.I.P.
The learned A.P.P. submits that the petitioner has got criminal antecedent.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Manjhi P.S. Case No.105 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
