19-04-2024 Heard learned counsel for the parties.
2. The petitioner seeks bail in a case registered for offence under Sections 373/34 of the Indian Penal Code.
3. As per F.I.R., the victim was recovered from the house of this petitioner.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and no case under Section 373 of the Indian Penal Code is made out against this petitioner. There is no allegation of any sexual assault against this petitioner. This petitioner is only alleged to have kept the informant in his house. He further submits that other co-accused namely Md. Zaheer Ahmad and Md. Subalin, who were instrumental in the alleged occurrence, have already been granted bail by this Court, vide order dated 21.03.2024 passed in Cr.Misc. No. 893 of 2024. Petitioner has got clean antecedent
Patna High Court CR. MISC. No.11156 of 2024(3) dt.19-04-2024 2/2 and is in custody since 18.09.2023. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Supaul in connection with Jadiya P.S. Case No. 240 of 2023.
