Although, one stolen motor cycle is said to have been recovered from the house of the petitioner but even if, prosecution story assumed to be true, then, also it was co-accused Sartaz Aalam, who committed theft of the aforesaid motor cycle and handed over to the petitioner for keeping the same. Petitioner does not have any criminal antecedent.
