JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Petitioner being husband of the victim is languishing in custody since 13.03.2012 in a case registered for the offences punishable under Sections 304B/34 of the I.P.C.
Accusation is killing the daughter of the informant within five years of marriage for non-fulfilment of dowry demand. The postmortem reflects the death due to head injury.
The report of the Superintendent of Police, Nalanda dated 22.12.2014 reflects that five witnesses have already been examined and the rest four witnesses were produced on 19.12.2014 but due to the paucity of time they could not be examined but they were supposed to be examined on 13.01.2014, the date fixed by learned Court below for their examination.
It is expected from learned Court below to
Patna High Court Cr.Misc. No.5380 of 2014 (4) dt.04-02-2015 2/2 conclude the trial within a period of four months. If the trial will not be concluded within a period of four months then the petitioner will be at liberty to renew his prayer for bail. Accordingly the application is disposed off in connection with Tharthari P.S. Case No. 06 of 2012, pending in the Court of learned Additional District Judge-III, Hilsa, Nalanda.
