Allegedly, an agreement for sale of the land was settled between the parties. As per allegation O.P. No. 2 paid rupees 5,20000/- to the petitioner but he did not execute registered sale deed of the land. Learned counsel for the petitioner has submitted that an amount of rupees 5,20000/- was not taken by him, but only rupees 4,00000/- was taken by the petitioner and the entire 4,00000/- were refunded to the Opposite Party.
The learned Additional P.P. has also submitted that
Patna High Court CR. MISC. No.1913 of 2020(3) dt.21-10-2021 2/2 rupees 4,00000/- have been refunded to the complainant. It appears to be a land dispute and admittedly rupees 4,00000/- have been refunded to the complainant. Considering the facts and circumstances, let the petitioner in the event of his arrest or surrender within four weeks before the court below or the police be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Complaint Case No. 1500 of 2017, Tr. No. 1989 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
