2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Tarapur P.S. Case No. 180 of 2024, lodged on 19.07.2024, under Sections 103(1)/3(5) of the Bhartiya Nyay Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against five named accused persons including the present petitioners with allegation that the marriage of the daughter of the
Patna High Court CR. MISC. No.2071 of 2025(3) dt.08-05-2025 2/3 informant was solemnized with Wakil Das son of Ganga Ravi Das at Tarapur, but the family of the in-laws used to torture the informant's daughter. On many occasion, compromise took place but ultimately they have killed the daughter of the informant.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that petitioner No.1 and Petitioner No.2 are Bhagina and Nanad of the deceased. Marriage of petitioner No.2, Nanad, has been solemnized 30 years back, she is aged about 48 years and age of her son is 30 years. They are living in separate house. Counsel submits that the husband of the deceased is already in judicial custody.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that from the pleading it transpires that petitioners are married Nanad and his son.
6. In the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the
Patna High Court CR. MISC. No.2071 of 2025(3) dt.08-05-2025 3/3 satisfaction of A.C.J.M.-III, Munger, in connection with Tarapur P.S. Case No. 180 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
