Patna High Court CR. MISC. No.11124 of 2019(6) dt.27-06-2019 2/3 ORAL ORDER 27-06-2019 This is an application for grant of anticipatory bail in connection with Marauna P.S. Case No.70 of 2018, G.R. No. 1423 of 2018, disclosing offences under Sections 147, 148, 149, 302, 307, 323, 324, 341, 379, 504 and 506 of IPC. F.I.R. disclosed an allegation that accused persons including the petitioners surrounded the informant and his father and there is allegation against one Arjun Yadav that he ordered, thereafter, one Arjun Yadav assaulted father of the informant on his head by but o the gun and also snatched Rs.13000/- and a golden chain as well as hand watch.
Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against any of the petitioners. They have falsely been implicated in this case. Heard learned A.P.P. as well as learned counsel appearing on behalf of the informant, who has opposed the prayer for bail on the ground that petitioners no.2, 4, 12, 13, 15 & 16 there is criminal antecedent as they are accused in another case. However, they have suppressed the antecedent. Having heard both sides, in view of the facts and circumstances, as stated above, so far as petitioners no.2, 4, 12, 13, 15, & 16 are concerned, I am not inclined to grant privilege of anticipatory bail to them, however, they are directed to
Patna High Court CR. MISC. No.11124 of 2019(6) dt.27-06-2019 3/3 surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned court below on its own merit, without being prejudiced by order of this Court.
So far as, other petitioners, namely, Jai Narayan Yadav, Ravindra Yadav @ Rajendra Yadav, Balel Safi, Md. Isha @ Ishakh Mansuri, Kaleshwar Yadav, Vinod Yadav, Kailu Yadav, Pramod Yadav, Phuls Bhandari @ Phyuleshwar Bhandari and Ramanand Thakur @ Ramanand Kumar Thakur, are concerned, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul/Incharge Successor Court, in connection with Marauna P.S. Case No. 70 of 2018, G.R. No. 1423 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure With the aforesaid, this application is disposed of.
