====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-09-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 364/34, 120(B) of the I.P.C. and later on, Section 309 of the I.P.C. was added. Petitioner is in custody since 23.06.2020. Suspicion is that the petitioner and others committed murder of the son of the informant as the deceased was in love with the daughter of the petitioner.
Submission is that false implication is there due to suspicion.
Considering the nature of material and period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.12775 of 2021(4) dt.07-09-2021 2/2 satisfaction of the learned Court-below where the case is pending in connection with Raghopur P.S. Case No. 147 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
