Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120B read with Section 34 of the Indian Penal Code.
As per the prosecution case, when the informant got secret information about Cyber Crime then he along with the police officials reached the place of occurrence. After
Patna High Court CR. MISC. No.2394 of 2023(3) dt.28-02-2023 2/3 seeing police party, the accused persons tried to flee away from there, thereafter one person was arrested who disclosed the name of the petitioner.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. The name of the petitioner has transpired on the basis of disclosure of the co-accused namely, Nitish Kumar. Nothing incriminating article has been recovered from conscious possession of the petitioner. He has further submitted that the similarly situated co-accused has been granted anticipatory bail by a Coordinate Bench vide order dated 24.11.2022 passed in Cr. Misc. No. 34031 of 2022. The petitioner has got clean antecedent as stated in para 3 of the bail petition.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/ surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned,
Patna High Court CR. MISC. No.2394 of 2023(3) dt.28-02-2023 3/3 Sheikhopur Sarai in connection with Sheikhopur Sarai P.S. Case No. 28 of 2022, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. The application stands allowed.
