2. The petitioner seeks bail in connection with Sessions Trial No. 1366 of 2024 arising out of Bakhtiyarpur P.S. Case No. 199 of 2024 instituted for the offences under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and later on added Section 302 of the I.P.C.
3. As per prosecution case, the accused persons including the petitioner have assaulted the Informant and others. It is alleged that the Informant's father died in course of his treatment.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged
Patna High Court CR. MISC. No.16320 of 2025(7) dt.27-08-2025 2/3 against him and has falsely been implicated in the present case. The present case is the counter blast of Bakhtiyarpur P.S. Case No. 216 of 2024. The name of the petitioner has surfaced in this case on the basis of the confessional statement of the co-accused Pankaj Kumar recorded before the police which has no evidentiary value in the eye of law and, except confessional statement of the co-accused, there is nothing adverse against the petitioner. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The specific allegation of assault is against the coaccused Jitendra Ravidas alias Chhathu and Niru Ravidas and the specific allegation of assaulting Chandani Kumar is against the co-accused Chhathu. The petitioner has no criminal antecedent and is languishing in judicial custody since 15.04.2024 without any rhymes or reason. He further submits that the charge-sheet has been submitted and the charge has also been framed.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, the petitioner having no

No.16320 of 2025(7) dt.27-08-2025 3/3 criminal antecedent, there being no specific allegation of assault as also the petitioner being lady, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sessions Trial No. 1366 of 2024 arising out of Bakhtiyarpur P.S. Case No. 199 of 2024.
