The petitioner seeks bail in Dumaria P.S. Case No. 62 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, co-accused Aquib Khan assaulted the informant with butt of pistol on his head at the instance of petitioner.

It is submitted on behalf of the petitioner that specific allegation of assault is against co-accused Aquib Khan. So far as this petitioner is concerned he is only alleged to have instigated Aquib to assault. Petitioner claims clean antecedent and he is in custody since 17.10.2021 Considering the facts and circumstances of the case,

Case No. 62 of 2021.
