Let the defect(s), if any, as pointed out by the office be removed within a period of four weeks from today. The petitioner seeks bail in connection with Revilganj P.S. Case No. 338 of 2020 registered for the offences punishable under Sections 188, 323, 332, 333, 353, 504 and 34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner and other co-accused persons misbehaved with the Circle Officer, who went to remove the encroachment and obstructed the official work.
It has been submitted by learned counsel for the petitioner that due to dispute with his agnates, a number of
Patna High Court CR. MISC. No.3169 of 2022(2) dt.06-06-2022 2/3 cases have been instituted, which has been mentioned in paragraph no. 3 of the present petition and the present case has also been instituted by same persons through the Circle Officer. Nothing came up against the petitioner in the instant case. Some of the petitioners got anticipatory bail vide order dated 25.01.2022 in Cr. Misc. No. 19504 of 2021. Another co-accused Rajnish Tiwari @ Mastan has already be released on bail vide order dated 22.06.2021 in Cr. Misc. No. 14482 of 2021. The petitioner is in custody since 16.11.2021. It has been submitted on behalf of the prosecution that the petitioner having criminal antecedent and there are three cases against him.
Having regard to the aforesaid facts and circumstances, considering the nature of allegation and the period of custody, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Chapra in connection with Revilganj P.S. Case No.
(i) One of the bailors will be a close relative of the petitioner, preferably one of his parents.
(ii) The petitioner will remain present on each and
