The petitioner apprehends his arrest in connection with Barun P.S. Case No.413 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from diyara area of Sone river. The petitioner has no concern with the alleged seized vehicle and liquor.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.4457 of 2023(2) dt.28-04-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Court No.I, Aurangabad in connection with Barun P.S. Case No.413 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
